Johnson & Johnson can’t avoid talc claims with bankruptcy

Johnson and Johnson (J&J) is such a big company that people trust it with their health. For decades, the company has been one of the biggest in the world. The organization has become a trusted household name. Countless people use their products as part of their daily routines.

Unfortunately, the company may not have earned that trust. J&J has faced multiple lawsuits in recent years related to its talc powder. Consumers have won large lawsuits related to asbestos contamination in talc powder. The civil courts have awarded multi-million-dollar judgments in some cases. Johnson and Johnson has tried to fight back, but the courts continue to protect consumers.

What Johnson and Johnson attempted

Johnson & Johnson has invested quite a bit in its efforts to fight talc powder lawsuits. The company has filed appeals after every major ruling. It has filed lawsuits against scientists to blame them for the lawsuits. Most recently, it has attempted to file for bankruptcy. The goal was to limit the company’s responsibility for asbestos-related illnesses.  A judge ruled that Johnson and Johnson could not end its asbestos liability through bankruptcy.

Consumers can continue to pursue compensation from J&J. The company knew about potential asbestos contamination. There are internal company memos that make that fact clear. It failed to properly label its products. It chose not to source talc from mines that had lower risk of contamination. The asbestos exposure consumers experienced may have caused their cancers. Those diagnosed with cancer after using talc powder may have grounds for a lawsuit. Holding companies of accountable for unsafe products may benefit those sickened by asbestos and other toxic substances.
