Ignorance, they say, is bliss. Unfortunately, many residents of Ohio don’t have the luxury of such ignorance when it comes to asbestos exposure and the cancer that often results. Because of the historical prevalence of asbestos in the manufacturing plants and industrial factories that covered the state, far too many individuals and their families are intimately familiar with the long-term health hazards of this carcinogenic substance.
In another state, a woman has recently filed a complaint against several companies alleging their liability for her late father’s death. The complaint claims that the companies’ negligence resulted in the man’s lung cancer after decades of asbestos exposure ranging from the 1950s to the 1990s. The woman’s father was employed as a laborer to various companies, and it was then, or during his military service, that he was exposed to the asbestos.
Specifically, the suit states the employers failed to provide adequate instructions on how to avoid inhaling the asbestos. Additionally, they failed to conduct testing on the products containing asbestos. This negligence led to the exposure to and inhalation, ingestion or absorptions of asbestos fibers emanating from the defendants’ products, which ultimately led to the lung cancer that claimed his life.
The plaintiff seeks punitive damages for misconduct and hopes that the action will deter other corporations in such situations from committing similar acts of misconduct. Additionally, she seeks judgment for actual and compensatory damages and other relief as the court sees fit. Residents of Ohio who have similarly lost a loved one to cancer caused by asbestos exposure due to corporate misconduct or negligence have the same right to seek the experienced legal counsel of an asbestos litigation attorney.
