Where should out-of-state drivers file personal injury lawsuits?

  |   Dec 31, 2017  |  Car Accidents

A car crash occurred in Ohio the day after Christmas, severely injuring all three individuals involved. A serious automobile accident is enough to ruin anyone’s holiday, but further complicating matters — should the injured victims choose to pursue a personal injury suit against the at-fault driver — is the fact that all parties involved were from out of state. According to Ohio State Highway Patrol, the wreck occurred when a man — believed to be under the influence of alcohol — drove his vehicle across the center line on State Route 43, striking an SUV traveling in the opposite direction.

The collision trapped the couple inside their SUV, seriously injuring them both. Rescue personnel had to cut them out. The SUV driver was transported via helicopter to a hospital for treatment of his life-threatening injuries. His wife, also seriously injured, was taken to a different hospital by ambulance.

The driver who is believed to be responsible for causing the crash was also trapped inside his vehicle and had to be cut out. He was then also taken to a hospital for treatment. While the crash remains under investigation, officials have indicated that they believe alcohol was a contributing factor.

The out-of-state couple is likely facing a long and costly recuperation after their ordeal. Even though neither they nor the driver who appears to have caused the collision are Ohio residents, they may still choose to seek the advice of an Ohio personal injury lawyer to explore their options for compensation for their injuries, including pain and suffering. In civil lawsuits, when a serious accident occurs, the courts in the state in which the incident took place typically has jurisdiction; however, jurisdictional issues are complicated and require a careful analysis before proceeding. Following any serious Ohio motor vehicle accident, an experienced attorney can offer legal advice on these and related issues.
