Many Ohio drivers may assume that due to the size and weight of 18-wheelers, truck drivers often enjoy more protection during crashes than those in smaller, passenger vehicles. However, that is not always the case. Sometimes, everyone survives these car accidents, even though they may suffer injuries, except the driver of the semi-trailer involved.
The Ohio State Highway Patrol recently responded to an accident on US 52 on a Wednesday afternoon. An eastbound vehicle pulled off the road, but only slightly. As cars went around the stopped vehicle, one ended up slamming into a big rig headed westbound. The impact caused the large truck to careen into the eastbound lane where it struck another vehicle, went down an embankment and came to rest near the Ohio River.
Surprisingly, all those occupying passenger vehicles survived the crash, but four people did suffer serious injuries. Sadly, the 59-year-old truck driver did not survive his injuries. At last report, police had not filed any charges in connection with the crash, and they may not depending on what the investigation reveals. While the surviving members of the deceased driver’s family may receive workers’ compensation benefits, that is not their only option.
Ohio law allows for the filing of a wrongful death claim in civil court so the family can pursue restitution for the damages sustained as a result of the death of their loved one. This process may provide them with additional damages not available through workers’ compensation.
