Anytime people here in Ohio or elsewhere see a crash involving an 18-wheeler, it would be easy to assume that the truck driver caused it. However, big rig drivers are not always at fault in vehicle accidents. Often, passenger car drivers are the ones who end up causing an accident.
Law enforcement officers here in Ohio report that the evidence in a recent crash involving a tractor-trailer and a passenger vehicle was not the fault of the truck driver. More than likely, the driver of the 18-wheeler did not have enough time to avoid the accident. The size and weight of these vehicles make quick stops or fast evasive maneuvers nearly impossible.
The other vehicle was traveling in the opposite direction of the truck at the time of the accident. For some reason, the driver lost control of the vehicle, which sent it through the median and into the path of the tractor-trailer. The 36-year-old driver of that vehicle was not alone.
He had a 30-year-old passenger riding with him. Neither survived the injuries each suffered in the impact. In fact, they never made it to the hospital.
The surviving family of the deceased passenger may exercise their right to file a wrongful death claim against the estate of the deceased driver seeking restitution for the loss of their family member. If the evidence presented to an Ohio court proves that the driver was negligent, then damages may be awarded. That monetary judgment could provide funds needed to reimburse the family for the expenses that accompany fatal vehicle accidents.
