What Is Mesothelioma?

Mesothelioma is a type of cancer that occurs in the mesothelium, a protective membrane that covers the lungs, abdomen, heart, and testes. Exposure to asbestos is known to cause most cases of mesothelioma. Asbestos fibers can easily become lodged in the mesothelium tissue and cause irritation. Symptoms of mesothelioma may not appear for decades after exposure.

There were 2,709 new cases of mesothelioma in 2023, according to the Centers for Disease Control and Prevention. While this was a 40% decrease from 2014, this shows that cases are still being discovered today. In Michigan, 88 new cases were reported.

Workers in the Lansing area may have been exposed to asbestos through jobs at automotive plants, government workplaces, construction sites, power plants, schools, or industrial maintenance companies. Asbestos products could be present in older buildings and facilities in the areas surrounding downtown Lansing, I-496, I-96, and US-127, requiring abatement work before any renovation or demolition.

In Michigan, asbestos abatement activities are regulated under the Asbestos Abatement Contractors Licensing Act (Public Act 135 of 1986). These laws establish licensing requirements for asbestos removal contractors to help prevent current exposures. However, these laws cannot undo the harm caused by asbestos used decades ago.

Mesothelioma Symptoms

Mesothelioma symptoms can mimic other more common respiratory problems, and many people don’t realize they have the disease until it has progressed. The symptoms vary depending on where cancer develops in the body, but they tend to worsen as the disease advances. The most common symptoms of mesothelioma include:

  • Chest pain
  • Persistent abdominal pain
  • Shortness of breath
  • Persistent coughing
  • Fatigue
  • Weight loss
  • Fluid near the lungs

Since symptoms can take years to present themselves, your doctor may recommend imaging scans, biopsies, and pathology tests to accurately diagnose mesothelioma.

Liability in Mesothelioma Cases

While you may think your employer is the only party responsible for exposing you to asbestos, you may be eligible to recover compensation from other parties. In fact, many mesothelioma claims involve defective manufacturers, suppliers, distributors, contractors, or building owners who produced, sold, or worked with asbestos-containing products.

Reviewing your work history, military service records, product documentation, construction records, and interviewing witnesses can help determine responsibility. In some cases, exposure to asbestos may have happened through multiple employers over the course of decades. If multiple companies contributed to your exposure, you may be able to file a claim against each party.

In Michigan, there are statutes of limitations that limit the amount of time a plaintiff has to file an asbestos claim. For personal injury, Michigan has a statutory deadline of three years under Michigan Compiled Laws § 600.5805.

Why Hire a Mesothelioma Lawyer?

When you hire a mesothelioma lawyer, you have access to the resources necessary to uncover past asbestos exposure. These claims can involve decades-old employment and product records, medical professional testimony, and asbestos trust fund documents.

A qualified attorney knows how to identify liable companies that manufactured or supplied the products containing asbestos. Your lawyer may be able to identify potential asbestos trusts, obtain your employment and medical records, locate professional witnesses, calculate your damages, and file all necessary claims in a timely manner that complies with Michigan statutes of limitation.

A Lansing mesothelioma attorney can also determine if exposure happened at more than one job, allowing you to pursue compensation from every party responsible for your injuries.

FAQs

Does Everyone With Mesothelioma Get a Settlement?

No, everyone with mesothelioma does not get a settlement. Payout depends on the circumstances of exposure and whether you meet the qualifications for filing a claim. You must be able to prove you were exposed to asbestos, identify the party or parties responsible for your exposure, meet your state’s filing requirements, and have medical evidence to prove your diagnosis is connected to that exposure.

What Are the Legal Options for Mesothelioma Patients?

Legal options for mesothelioma patients depend on how and when you were exposed to asbestos. You may be eligible to file a personal injury claim, make claims with asbestos bankruptcy trust funds, file for workers’ compensation, or file a claim for veterans’ benefits if your exposure occurred during military service. In some cases, victims can qualify for multiple types of compensation simultaneously.

How Do You Prove Mesothelioma?

Mesothelioma is proven through your medical records. You may need a pathology report or other medical proof that you were diagnosed with mesothelioma. You may also need to have proof that you were exposed to asbestos. Evidence for this could include employment histories, military service papers, statements from witnesses, or pinpointing products with asbestos found at your former workplaces. All this information can help prove your illness and its cause.

Can Family Members Pursue a Mesothelioma Claim After Death?

Yes, in most instances, family members can pursue a claim after death. If your loved one passes away while a claim is in process, you may be able to either file on behalf of their estate or as an eligible family member. Many states allow for a wrongful death claim to be filed in addition to the original claim.
