Securing compensation through a mesothelioma claim often requires tracing asbestos exposure back several decades.
Research published in JCO Global Oncology highlights the scale of this issue: approximately 96% of U.S. mesothelioma deaths in 2023 were linked to occupational asbestos exposure, with overall survival rates remaining largely unchanged over the past 30 years.
Reconstructing an employment history in Alabama can be complex. Companies close, names change, and crucial records become scattered over time.
You don’t need to gather all the evidence before reaching out. At Kelley Ferraro, LLC, we handle the investigation for you, analyzing job sites, product records, and employment histories to pinpoint exposure sources.

Alabama has a long history of industries that used asbestos-containing materials. Exposure may have occurred in workplaces involving:
People who worked in Birmingham, Mobile, Huntsville, Montgomery, Tuscaloosa or elsewhere in Alabama may have been exposed to asbestos in insulation, pipe, cement or brakes.
One federal court opinion describes claims from workers at a Ragland, Alabama plant that made pipe from asbestos and cement. Other exposure may have happened in shipyards, mills, power plants or other industrial sites.
Asbestos fibers can also travel home on work clothing. Family members who breathe them in may have secondhand exposure.
That does not prevent an investigation.
Mesothelioma can develop decades after exposure, so many people cannot recall every employer or product.
We look at employment records, union files, company records and accounts from former coworkers to piece together what happened. We work with what you remember and investigate the rest.
Alabama sets time limits for filing a claim, and asbestos claims follow a different rule than most injury claims.
For many Alabama personal injury claims, the statute of limitations is two years. Asbestos-related claims are addressed under Ala. Code § 6-2-30, and courts have applied a discovery rule in certain cases involving exposure occurring after 1979.
Under that rule, the time limit may start when the person knew, or should have known, of the asbestos-related disease.
The date of diagnosis, the history of exposure and other facts can change which time limit applies.
When mesothelioma causes a death, Ala. Code § 6-5-410 provides a separate wrongful death claim. A personal representative generally must bring the claim within two years of the death.
Alabama wrongful death law generally allows only punitive damages. Those damages punish a wrongdoer instead of repaying losses.
A company responsible for asbestos exposure may no longer exist. Some companies that made or sold asbestos products went bankrupt and set up trusts to pay eligible victims.
Alabama also has rules for asbestos trust claims. Under the Alabama Asbestos Exposure Transparency Act (Act 2019-261, Ala. Code §§ 6-5-690 through 6-5-694, amended in 2024), a plaintiff in an asbestos lawsuit must either disclose detailed exposure information or file all available trust claims and share the trust claim materials.
A mesothelioma case may therefore involve both a lawsuit and trust claims. We can identify the companies, products and worksites connected to your exposure, then explain how those claims may fit together.
Asbestos cases depend on old records that are hard for a family to find alone. We handle asbestos and mesothelioma cases, including claims where the exposure happened many years before diagnosis.
In 2021, a Kelley Ferraro trial team obtained a $10.6 million jury verdict for the widow of a mechanic who developed mesothelioma after asbestos exposure from brakes. Equity Partners John Martin Murphy and James L. Ferraro oversaw the trial team, with Shawn M. Acton serving as lead counsel.
Past results do not guarantee a similar outcome in another case. The circumstances of each mesothelioma claim are different.
Medical care comes first, and we handle the investigation that supports a claim. Our attorneys can:
Pleural mesothelioma affects the lining around the lungs. Peritoneal mesothelioma affects the lining of the abdomen. We represent people diagnosed with either form.
When Medicare has paid for treatment, it may have a right to reimbursement from a recovery. Our firm provides information about Medicare right to reimbursement and can address that issue as part of the claim.
You do not need a complete employment history or a file full of documents before contacting us.

If some of those details are missing, that is common. The first review identifies what information is available and what further investigation may be possible.

Asbestos exposure is the main known cause of mesothelioma, and it often happens at work or through secondhand contact. The disease may not appear until decades later.
Alabama allows two years for many personal injury claims, and asbestos claims may follow a discovery rule in certain cases. The exposure date, the date the disease was discovered and other facts can change the deadline.
A personal representative generally has two years from the date of death to file under Ala. Code § 6-5-410. Because asbestos claims can raise other legal issues, we review the facts promptly.
It may, if asbestos fibers brought home on a family member’s clothing contributed to the disease. The evidence and legal requirements depend on the individual case.
Bankruptcy does not always end the chance of compensation, because some asbestos companies set up trust funds for injured people. Alabama law also requires asbestos plaintiffs to disclose exposure details or file available trust claims.
Personal injury claims may seek losses tied to the disease and its treatment. Alabama wrongful death law generally allows only punitive damages.
